Pursuant to the Master Sales Agreement, Calimetrix, LLC, (“Calimetrix”) only provides a limited warranty to the original Buyer for the products Calimetrix manufactures and sells. For certain products, Calimetrix offers a Specific Product Limited Warranty to the original Buyer to the extent stated below. Warranty terms specifically noted in an applicable quote or Purchase Order will take precedence over the terms stated below.

Specific Product Limited Warranty for Model 300, Model 450, Model 600, Model 725, and Model 825 Phantoms (“Housing-Based Phantoms”). For Housing-Based Phantoms, Calimetrix warrants to Buyer only, that, (i) so long as Housing-Based Phantoms remain at a single physical site, the Housing-Based Phantoms shall remain free of Defects for a period of one (1) year from the date of delivery, and (ii) if Buyer ships, relocates, or otherwise moves the Housing-Based Phantoms any time within that initial one (1) year period, the Housing-Based Phantoms shall remain free of Defects for a period of three (3) months from the date of the first relocation, shipment, or movement. The Specific Product Limited Warranty for Housing-Based Phantoms: (A) will in no event ever exceed a total period of one (1) year from initial delivery to Buyer; (B) does not warrant against ordinary wear and tear; (C) is void and does not apply to Housing-Based Phantoms physically damaged by Buyer by dropping, misusing, allowing the Housing-Based Phantom to freeze, or failing to maintain the Housing-Based Phantoms within the temperature range set forth in the user manual; and (D) is void and does not apply if any attempt is made to unscrew, disconnect, or otherwise alter or tamper with the two hemispheres of the Housing-Based Phantom. Unless specifically noted otherwise in an applicable Purchase Order, Calimetrix will assume that the Housing-Based Phantom is being shipped or moved to multiple sites and the default period for the Specific Product Limited Warranty for Housing-Based Phantoms shall be three (3) months from initial delivery.

Specific Product Limited Warranty for Phantom Packs (formerly known as Vials-Only Phantoms). For Phantom Packs, Calimetrix warrants to Buyer only that the Phantoms shall remain free of Defects for a period of three (3) months from the date of delivery. The Specific Product Limited Warranty for Phantom Packs: (A) does not warrant against ordinary wear and tear; (B) is void and does not apply to Phantom Packs physically damaged by Buyer by dropping, misusing, allowing Phantom Packs to freeze, or failing to maintain the Phantom Packs within the temperature range set forth in the user manual.

Specific Product Limited Warranty for Phantom Pack Accessory Pads. For Phantom Pack Accessory Pads, Calimetrix warrants to Buyer only that the Pads shall remain free of Defects for a period of six (6) months from the date of delivery. The Specific Product Limited Warranty for Phantom Pack Accessory Pads does not warrant against ordinary wear and tear.

Specific Product Limited Warranty for Special Order Phantoms [For Special Order MSK Phantoms, see below].For Special Order Phantoms, Calimetrix warrants to Buyer only, that the Phantoms shall remain free of Defects for a period of three (3) months from the date of delivery. The Specific Product Limited Warranty for Special Order Phantoms: (A) does not warrant against ordinary wear and tear; and (B) is void and does not apply to phantoms physically damaged by Buyer by dropping, misusing, or allowing the phantoms to freeze.

Specific Product Limited Warranty for Special-Order MSK Relaxometry Phantom. For the Special-Order MSK Relaxometry Phantom, Company warrants to Buyer only, that:

• (i) so long as the Special-Order MSK Relaxometry Phantom remains at a single physical site:

•  the Housing of the Special-Order MSK Relaxometry Phantom shall remain free of Defects for a period of one (1) year from the date of delivery; and

• the vials and the gel contents of the vials contained in the Special-Order MSK Relaxometry Phantom shall remain free of Defects for a period of three (3) months from the date of delivery.

•  and (ii) if Buyer ships, relocates, or otherwise moves the Special-Order MSK Relaxometry Phantom any time within that initial one (1) year or three (3) month period:

• the Housing of the Special-Order MSK Relaxometry Phantom shall remain free of Defects for a period of three (3) months from the date of the first relocation, shipment, or movement, with the total warranty period in no event to ever exceed a total period of one (1) year from initial delivery to Buyer; and

• the vials and the gel contents of the vials contained in the Special-Order MSK Relaxometry Phantom shall remain free of Defects for a period of one (1) month from the first relocation, shipment, or movement, with the total warranty period in no event to ever exceed a total period of three (3) months from initial delivery to Buyer.

• The Specific Product Limited Warranty for the Special-Order MSK Relaxometry Phantom: (A) does not warrant against ordinary wear and tear or discoloration; (B) is void and does not apply to Special-Order MSK Relaxometry Phantom physically damaged by Buyer by dropping, misusing, or allowing the Special-Order MSK Relaxometry Phantom to freeze or otherwise not maintain the Special-Order MSK Relaxometry Phantom within the temperature range set forth in the user manual; and (C) is void and does not apply if any attempt is made to unscrew, disconnect, or otherwise alter or tamper with the Special-Order MSK Relaxometry Phantom. The breaking of, damage to, or limitations or cessation of the functionality of any thermometer placed in or on the Housing of the Special-Order MSK Relaxometry Phantom is excluded from all above warranties. Unless specifically noted otherwise in an applicable Sales Order, Company will assume that the Special-Order MSK Relaxometry Phantom is being shipped or moved to multiple sites and the default period for the Specific Product Limited Warranty for the Housing of the Special-Order MSK Relaxometry Phantom shall be three (3) months from initial delivery and the default period for the Specific Product Limited Warranty for the vials and the gel contents of the vials contained in the Special-Order MSK Relaxometry Phantom shall be one (1) month from initial delivery.

Specific Product Limited Warranty for Special-Order MSK Phantom Stands. For the Special-Order MSK Phantom Stands, Company warrants to Buyer only, that, (i) so long as Special-Order MSK Phantom Stands remains at a single physical site, the Special-Order MSK Phantom Stands shall remain free of Defects for a period of one (1) year from the date of delivery, and (ii) if Buyer ships, relocates, or otherwise moves the Special-Order MSK Phantom Stands any time within that initial one (1) year period, the Special-Order MSK Phantom Stands shall remain free of Defects for a period of three (3) months from the date of the first relocation, shipment, or movement. The Specific Product Limited Warranty for Special-Order MSK Phantom Stands: (A) will in no event ever exceed a total period of one (1) year from initial delivery to Buyer; (B) does not warrant against ordinary wear and tear or discoloration; and (C) is void and does not apply to Special-Order MSK Phantom Stands physically damaged by Buyer by dropping or misusing Special-Order MSK Phantom Stands. Unless specifically noted otherwise in an applicable Sales Order, Company will assume that the Special-Order MSK Phantom Stands is being shipped or moved to multiple sites and the default period for the Specific Product Limited Warranty for Special-Order MSK Phantom Stands shall be three (3) months from initial delivery. This warranty applies to Special-Order MSK Phantom Stands sold individually and to those sold as a set.
